Stop Workplace Sexual Harassment with Rich Daugherty

If you are experiencing sexual harassment in the workplace it can be hard to speak up. Sexual harassment can happen to anyone, any gender or sexual orientation and can be between boss / superior or peer to peer. Sexual harassment can take many forms. It can be verbal (such as jokes or unwelcomed comments), non-verbal (such as gestures or staring), physical conduct (such as unwanted touching or groping), or visual (such as emails or cartoons).

This conduct violates the law when it is so extensive or severe that it creates a hostile, intimidating, or offensive work environment, or if your employer makes employment decisions based on you reporting the inappropriate conduct or if your job depends on the acceptance of unwanted sexual advancements. It is also illegal for your employer to retaliate in any way against you for reporting sexual harassment.

If you are being sexually harassed at work, there are some steps you should take:

1) Tell the person that the conduct is unwanted and must stop. Be clear.
2) Report to someone in an authoritative position that the conduct is happening.
3) Follow your company’s internal process for filing the complaint.
4) Keep records and document when the harassment is happening and when you have reported it. Include details of the specific conduct, where it happened, time and date of occurrence and any potential witnesses. If the conduct is visual, keep copies of the materials such as graphic cartoons or emails.
5) Keep records of your performance evaluations during this time.
6) Talk to trusted family and friends.
7) Contact an experienced employment law attorney.
